Court admits appeal against demolition of historic Fuerteventura home
The Administrative Court number 6 of Las Palmas de Gran Canaria has admitted for processing the appeal lodged by Pascuala Roger Pérez, owner of a historic home awaiting demolition on the Fuerteventura coast, against the order authorising entry into the property, located at Cueva de la Negra. The court ruling gives notice of the appeal to the other parties, who have fifteen days to formally lodge their opposition.
The court also records the documentation added to the proceedings, including communication from Pájara Council requesting suspension of the demolition, along with submissions relating to the Civil Guard report and the technical report provided by Pascuala Roger’s legal representation, which have been passed to the respondent administration for its information.
Family highlights safeguards set out in the contested order
The family further recalls that the contested order itself establishes guarantees and limits for entry into the home and obliges the administration to report to the court on the carrying out of the entry and on any incident that may arise during its execution.
In light of this situation, Pascuala Roger’s family has expressly asked the Costas Authority (Demarcación de Costas) not to carry out the action scheduled for 21 September and to refrain from any intervention at Cueva de la Negra until the appeal, which has already been admitted for processing, is resolved.
The family argues that, with a judicial decision pending on the very order authorising the entry, the Costas Authority should wait for the appeal to be resolved before carrying out an action that could have irreversible consequences and render the protection sought from the courts practically ineffective.
Family laments absence of Cabildo from proceedings
The family also regrets that, despite the precautionary measures adopted by the Cabildo of Fuerteventura for the protection of the home, its immediate surroundings and the subsoil, this ruling does not record the Cabildo joining the proceedings, nor any direct intervention by the institution in defence of its own precautionary measures before the court.
For all these reasons, the family reiterates its request: that the Costas Authority does not act on 21 September and waits for the courts to resolve the appeal lodged by Pascuala Roger.
