Urgent evacuation ordered at Bajamar building
The Municipal Urban Planning Department of La Laguna Council has notified the owners of the Edificio D cil in Bajamar of an urgent evacuation resolution for the building, located on the main road from the town towards Punta del Hidalgo. The measure has been taken as a precautionary step to protect people, given the absence of sufficient technical guarantees regarding the building’s structural stability.
A decision based on technical and legal criteria
The council explains that the resolution responds exclusively to technical and legal criteria, aimed at guaranteeing people’s safety and ensuring compliance with the conservation obligations set out in urban planning regulations. The decision follows checks carried out by the Urban Discipline Service, which include a technical inspection performed by staff from the autonomous body, and comes after the receipt of a report issued by the supervising direction of the building’s ongoing refurbishment works. That report concludes expressly that, due to the current state of the works and the reinforcement actions still pending, it is not possible to guarantee the building’s stability.
Meeting with residents and a direct line of communication
The Municipal Urban Planning Department also held an informative meeting with the community of owners, at which the content of the resolution, the scope of the precautionary measures and the obligations arising from the current enforcement orders were set out. In addition, a direct communication channel has been established with the community of owners to provide updated information and coordinate the necessary actions during the process.
Social support and security operation
The council has activated a coordinated social support and security operation to ensure compliance with the precautionary measure and to assist those affected. This operation includes surveillance of the building to prevent unauthorised access, along with the offer of temporary accommodation resources and social support, depending on the needs of each family unit, although most of those affected have alternative personal accommodation available.
A repeat of the 2019 evacuation order
The council recalls that, in 2019, the Municipal Urban Planning Department ordered the urgent evacuation of the building following a technical report warning of a possible risk of structural collapse, although reoccupation was permitted a week later after an external certified assessment confirmed that the structure still maintained stable conditions, always subject to structural reinforcement works being carried out.
Almost seven years on, the documentation added to the case file and the technical inspection carried out show that the refurbishment works have not been completed, that structural elements remain pending intervention, and that neither the owners nor the contractor have been able to access all the premises to carry out the necessary reinforcements. During that inspection, it was confirmed that shoring was present in some premises and that cracks were visible on the exterior, without it being possible to access all the affected spaces. The report also notes that some of the visible shoring lacked the necessary elements to guarantee a correct transmission of loads, a circumstance that must be reinforced with a more extensive technical assessment.
No updated certification of structural safety
All these circumstances, together with the updated report from the supervising direction and the absence of an updated technical certification guaranteeing the structural safety of the entire building, along with the potential seriousness of a structural failure, mean that the necessary conditions to maintain occupation of the building are not met. This has therefore led to the adoption of a precautionary evacuation measure to protect people’s safety, in accordance with current legislation.
Evacuation within 24 hours and urgent checks
The resolution orders the evacuation of all homes and premises within a maximum of 24 hours, as well as an urgent technical check of the existing shoring and the state of the affected structural elements, including those spaces that could not be accessed, within a period of three days. These actions must be carried out under the direction of a competent technical specialist and under the safety conditions that this specialist determines.
The resolution establishes that the measure may be lifted if an updated technical certificate is provided, issued by a specialist company, expressly certifying the building’s structural safety and the conditions for its possible reoccupation. The notified resolution also brings the administrative process to a close and sets out the contentious-administrative appeals that may be lodged with the competent body.
