Tourist law affected owners demand parliamentary debate
Those affected by the Canary Islands tourist law are calling for the PSOE’s proposal to be debated in the Canary Islands Parliament, aimed at finding a solution for people who live in tourist areas or who do not wish to hand over their apartments for tourist exploitation: “We ask that our homes be respected.”
PALT backs the proposal being processed and improved
The PALT (Platform for Those Affected by the Tourist Law) has expressed its support for this Bill being processed, debated and improved by the Canary Islands Parliament as a whole, because it believes it introduces into the debate an issue that is essential for thousands of property owners: legally distinguishing between what is a home or an apartment and what is a tourist establishment and an accommodation unit.
The platform understands that this initiative can and should be enriched during its parliamentary processing, with contributions from all political groups and also with the participation of Canarian society. Because it maintains that what is at stake is no minor matter. “We are talking about the tourism, territorial and residential model of the Canary Islands. And an issue of this magnitude deserves a complete, transparent and democratic parliamentary debate,” says the PALT.
Not asking for a home, but not having theirs taken away
Likewise, those affected stress that they are not asking for a home, but rather that the ones they already own are not taken away from them. The PALT denounces that the problem arose when, through a subsequent legislative and interpretative evolution, an attempt was made to attribute to those properties a nature different from the one with which they were acquired.
That, it states, is what both Law 2/2013 and the holiday rental law approved in December 2025 do. The holiday rental law, it underlines, establishes that buildings divided under horizontal division of ownership will be considered tourist establishments and their apartments and bungalows as accommodation units for tourist purposes.
Properties acquired as homes under the horizontal property regime
These are properties whose owners acquired them under the horizontal property regime and in accordance with the land registry publicity and the constitutive titles as homes, in a residential building where, if the lawful owner so decided, they could be exploited for tourism, and for the period agreed by the parties, points out the PALT.
Now, decades later, they may end up being considered as accommodation units integrated into tourist establishments whose exclusive and mandatory use, forever, is tourist use. “This is the disguised expropriation of use without the constitutional guarantees being respected,” state those affected.
Not against tourism, but against converting homes into instruments
The PALT insists that it is not against tourism, but that protecting an economic activity is one thing and turning citizens’ properties into necessary instruments for the development of that activity is quite another.
