Court Upholds Prison Sentence for Los Cristianos Assault
The High Court of Justice of the Canary Islands (TSJC) has confirmed a two-year prison sentence handed down to a man for the sexual assault of a tourist in Los Cristianos, Tenerife. The sentence, originally issued by the Sixth Section of the Provincial Court of Santa Cruz de Tenerife, states that the convicted man, acting with libidinous intent, took advantage of the victim’s intoxicated state to subject her to various sexual acts.
Details of the Night in Question
The incident took place on 23 October 2023. The victim, accompanied by a friend, had been at an establishment in the San Telmo Shopping Centre in Los Cristianos, where the convicted man worked as a waiter. In the early hours, the two friends accepted an invitation from the venue’s owner to go to a private apartment to continue drinking.
Later, the victim, tired from the alcohol consumption, lay down on a sofa in the living room and began to doze off. The court found that it was at this moment the accused, with libidinous intent, took advantage of her drunkenness to subject her to sexual acts. The ruling notes that it was not proven that penetration occurred.
Compensation Ordered for Victim
In addition to the two-year prison term, the court has upheld an order for the accused to pay the victim €2,000 in compensation for the damages suffered.
